Acceptance of Terms

1. Acceptance of Terms

By downloading or using Caregiver Sync (the “App”), you agree to be bound by these Terms of Use. If you do not agree, you must not use the App.

2. Scope of License

Caregiver Sync grants you a non-transferable license to use the App on any Apple-branded or Android devices that you own or control, as permitted by the App Store Terms of Service and Google Play Terms of Service. This license does not allow you to use the App on any device that you do not own or control. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense the App. This license may be extended to other accounts associated with you via Family Sharing.

3. Description of Service

Caregiver Sync is a family care coordination platform designed to help families coordinate care for elderly or dependent members. Features include:

• Daily care activity logging
• Family communication tools
• Timeline tracking
• Notifications and reminders

4. User Responsibilities

You agree to:

• Provide accurate and current information
• Keep your account information secure
• Be responsible for all activities under your account
• Not use the App for illegal purposes

5. Family and Care Roles

• Owners: Create the family circle, have full control over data and members.
• Admins: Can manage members and logs but cannot delete the circle.
• Members: Can view and add logs but cannot change settings.

6. Content and Conduct

You agree not to:

• Share false or misleading medical information
• Harass or abuse other members
• Attempt to violate the security of the App
• Upload viruses or malicious code

7. Intellectual Property

The App and its original content are owned by Mictodev and protected by copyright laws. In the event of any third-party claim that the App or your use of the App infringes a third party’s intellectual property rights, Mictodev, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

8. Medical Disclaimer

Caregiver Sync is NOT a medical device. The information provided does not substitute professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions concerning a medical condition.

9. Maintenance and Support

Mictodev is solely responsible for providing maintenance and support services for the App. Apple and Google have no obligation to provide any maintenance or support services for the App.

10. Warranty

Mictodev is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation with respect to the App.

11. Product Claims

Mictodev, not Apple or Google, is responsible for addressing any claims relating to the App or your use of it, including but not limited to:

• Product liability claims
• Any claim that the App fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

12. Legal Compliance

You represent and warrant that:

• You are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country
• You are not listed on any U.S. Government list of prohibited or restricted parties

13. Limitation of Liability

Caregiver Sync shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the App.

14. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Use.

15. Changes to Terms

We may modify these terms at any time. Your continued use of the App after changes constitutes your acceptance of the new terms.

16. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms of Use. Upon your acceptance of these terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

17. Governing Law

These terms are governed by international laws, without regard to conflict of law provisions.
